Claims for personal injuries and death arise when caused by the deliberate or negligent acts of a person or corporate body or as a result of a breach of a statutory duty. Claims in these circumstances must be instituted within three years of the date of the accident.
Where children and young people under the age of 18 are concerned, the three-year period runs from his or her 18th Birthday, and such claims will initially have to be pursued on their behalf with the parents/carers consent and authority.
There are instances where the limitation date can be extended such as when knowledge that an injury has been caused comes to light many years later as in the case of wrong diagnosis or exposure to asbestos.
